Adopt a Resolution APPOINTING AND PROVIDING FOR THE COMPENSATION OF THE INTERIM DISTRICT COUNSEL.

SUMMARY:
The Board of Directors is responsible for the appointment of the District Counsel, a Board Appointed Officer and Unclassified employee of the Santa Clara Valley Water District (Valley Water).

Since January 2021, the District Counsel position has been filled in an Acting capacity through a rotating schedule of three Senior Assistant District Counsel staff identified by current District Counsel, Stan Yamamoto, who is retiring effective May 3, 2021.

Valley Water's Board of Directors has conducted a successful recruitment for a successor District Counsel who is scheduled to begin on June 1, 2021. For the period between Mr. Yamamoto's May 3, 2021 retirement and the June 1, 2021 starting date for his successor, the Board will need to appoint an Interim District Counsel.

Chair Estremera recommends continuing the rotation schedule established by Mr. Yamamoto and appointing Senior Assistant District Counsel Anthony Fulcher to serve as Interim District Counsel from May 4, 2021 through May 31, 2021. As part of the rotation, Mr. Fulcher has previously served as Acting District Counsel in February 2021. Having Mr. Fulcher appointed to the Interim District Counsel position for the remainder of May 2021 will help ensure a smooth transition.

Based on the limited term of the appointment and Mr. Fulcher's retention of his regular duties, there is no salary or benefit change associated with the new appointment.
