RECOMMENDATION: Recommendation
A. Adopt the Resolution AMENDING RESOLUTION 2025-08 TO CONTINUE THE SECOND AND THIRD HEARING DATES ON THE PUBLIC HEARING TO CONSIDER COMMENTS FROM MEMBERS OF THE PUBLIC ON THE REPORT ON THE ACTIVITIES IN THE PROTECTION AND AUGMENTATION OF THE WATER SUPPLIES OF THE SANTA CLARA VALLEY WATER DISTRICT, FISCAL YEAR 2025-2026; and
B. Set the continued times and dates for the second and third days of this Public Hearing to April 25, 2025, at 7:00 p.m. in the City of Morgan Hill Council Chamber Building, and May 16, 2025, at 1:00 p.m. in the Santa Clara Valley Water District Boardroom.

SUMMARY:
Section 26.5 of Santa Clara Valley Water’s District’s (Valley Water) District Act requires Valley Water to annually prepare a written report on its activities in the protection and augmentation of water supplies (PAWS Report) in the District. District Act Section 26.6 requires a Public Hearing to be held that allows any well owner/operator and surface water permittee within the District, or any person interested in the District's activities in the protection and augmentation of water supplies, including any proposed increase in groundwater production charges, to appear and submit evidence concerning the subject of the PAWS Report.
On February 11, 2025, the Board of Directors passed Resolution No. 2025-08, Calling a Public Hearing to Consider Comments from Members of the Public on the Report on the Activities on the Protection and Augmentation of the Water Supplies for Fiscal Year 2025-2026. The Resolution set the following public hearing dates and times: starting on April 8, 2025 at 1:00 p.m.; continuing to April 10, 2025 at 7:00 p.m. (at the City of Morgan Hill Council Chamber Building; and concluding on April 22, 2025 at 1:00 p.m.
Due to Director and Staff scheduling conflicts, Valley Water staff recommend continuing the second and third dates of this public hearing from their current dates to April 25, 2025, and May 16, 2025, respectively, as set forth in the attached proposed Resolution and Public Hearing Notice.
ENVIRONMENTAL JUSTICE AND EQUITY IMPACT:
There are no Environmental Justice Impacts associated with this action.
FINANCIAL IMPACT:
Though setting the date for a Public Hearing does not have any direct financial impact, the Public Hearing will affect the future finances of the Water Utility Enterprise.
CEQA:
The recommended action does not constitute a project under CEQA because it does not have a potential for resulting in direct or reasonably foreseeable indirect physical change in the environment.
