Adopt the Resolution SETTING TIME AND DATE OF PUBLIC HEARING ON THE FINAL MITIGATED NEGATIVE DECLARATION AND ENGINEER’S REPORT FOR THE PENITENCIA WATER TREATMENT PLANT RESIDUALS MANAGEMENT PROJECT, to occur on April 8, 2025, at 1:00 p.m. in the Boardroom at Santa Clara Valley Water District, Headquarters Building, 5700 Almaden Expressway, San Jose, California.

SUMMARY:
The objective of the Penitencia Water Treatment Plant (PWTP) Residuals Management Project (Project) is to address age, capacity, efficiency, and reliability issues with the plant’s existing Residuals Management System (RMS) to ensure that the PWTP efficiently and reliably provides potable water to retailers in Valley Water’s service area while meeting applicable regulatory standards. The scope of work for the Project includes improvements to the following components of the RMS: washwater handling and treatment, sludge handling and dewatering, and sedimentation basin sludge withdrawal.
Attachment 1 contains the resolution to set the time and place for the public hearing.
Final Mitigated Negative Declaration
Valley Water staff prepared a Final Mitigated Negative Declaration (MND) for the Board’s consideration and adoption prior to approving the proposed Project.
Engineer’s Report
Section 12 of the District Act requires the Board to conduct a public hearing to consider all written and oral objections to the proposed Project when: 1) the project is new construction; and 2) the project is funded by a single or joint zone of benefit. As the proposed Project meets both conditions, staff has prepared an Engineer’s Report (Attachment 2) for the purpose of public disclosure.
Staff is recommending that the Board set a public hearing for April 8, 2025, at 1:00 p.m. to hear public comments on Santa Clara Valley Water District’s (Valley Water) Final MND determination and Engineer’s Report. Following the public hearing, the Board will consider the Final MND determination before considering approving the Engineer’s Report and the proposed Project. The Notice of Public Hearing for the Engineer’s Report and Final MND is provided in Attachment 3.
ENVIRONMENTAL JUSTICE AND EQUITY IMPACT:
There are no environmental justice and equity impacts associated with the recommended action for the Penitencia Water Treatment Plant Residuals Management Project. The recommended action is unlikely to or will not result in human health or environmental effects; and/or is not associated with an equity opportunity.
FINANCIAL IMPACT:
There is no financial impact associated with approving staff’s recommendation to set a Public Hearing on the Engineer’s Report to consider the Project. The estimated cost to plan, design, and construct the above-described Project is $95.36 million (with inflation). The Project, Project No. 93234044, is included in the Capital Improvement Program Fiscal Year (FY) 2025-29 Five-Year Plan and in the FY 2024-25 Adopted Budget. The Project is funded by the Water Utility Enterprise Fund, with 100% of the costs allocated to Zone W-2 (North County).
CEQA:
The recommended action does not constitute a “project” under California Environmental Quality Act (CEQA) because it does not have the potential for resulting in direct or reasonably foreseeable indirect physical change in the environment.
