Agreement History
On October 23, 2023, the CEO approved agreements with EMC Research, Inc. and Probolsky Research for a total not-to-exceed amount of $225,000 each. Additionally, on November 14, 2023, Fairbank, Maslin, Maullin, Metz and Associates, Inc., operating as FM3 Research, was awarded an agreement for a total not-to-exceed amount of $225,000. These three On-Call agreements were awarded through competitive solicitation (RFP No. VW0259), with a combined not-to-exceed amount of $675,000. Because the three agreements were awarded under the same competitive solicitation, the cumulative not-to-exceed value of the agreements is relevant when determining the appropriate approval authority for subsequent contract actions.
Amendment No. 1 to Agreement No. A4909G
Board approval is requested for Amendment No. 1 to Agreement No. A4909G in consideration of the cumulative not-to-exceed value of the agreements awarded under RFP No. VW0259. The proposed additional services remain within the scope of services established under the original competitive solicitation. Amendment No. 1 to Agreement No. A4909G with EMC Research, Inc. would increase the not-to-exceed amount by $190,000, from $225,000, for a revised not-to-exceed total of $415,000 and extend the agreement term through June 30, 2027.
These services are essential to Valley Water’s ongoing outreach, communication, public engagement, and policy-related efforts. EMC Research currently has active task orders requiring additional contract capacity to complete planned and ongoing assignments. EMC also possesses specific experience and institutional knowledge relevant to upcoming assignments, providing continuity and efficiency in the performance of these services. Approval of the amendment will ensure continued access to timely public opinion research and community feedback, avoiding potential delays or disruptions to planned and ongoing initiatives.
ENVIRONMENTAL JUSTICE IMPACT:
There are no environmental justice impacts associated with this item.
FINANCIAL IMPACT:
The Agreement is for a revised total not-to-exceed fee of $415,000. There are adequate funds in the FY 2026-27 Adopted Budget for anticipated expenditures this year.
CEQA:
The recommended action does not constitute a project under the California Environmental Quality Act (CEQA) because it does not have the potential to result in a direct or reasonably foreseeable indirect physical change in the environment.
