SUMMARY:
Valley Water received a claim on June 27, 2023 from Gilroy resident, Mark Woodlief. According to the claimant, on April 13, 2023, at approximately 9:00 - 10:00 am, his vehicle's windshield was cracked due to a flying rock thrown by a weed whacker.
The claimant is seeking reimbursement of $465.00 for windshield repairs.
Risk Management has performed research and determined that Valley Water is not responsible for the damage to the claimant's vehicle. The work vehicle depicted in the photographs (Exhibit A) provided by the claimant is not a Valley Water vehicle. Furthermore, at the time of the incident, his vehicle was parked at 150 Cosmo Avenue in Morgan Hill which is adjacent to a self-storage facility which Valley Water has no known interests.
Therefore, there is no liability on the part of Valley Water, and staff recommends that the claim be denied.
