SUMMARY:
Tabitha Anderson submitted a written claim (“Claim”) to Santa Clara Valley Water District (Valley Water) that the Clerk of the Board received by mail on July 28, 2026. The Claim demands compensation for injuries she allegedly sustained on February 8, 2026 at 6:45 p.m. when she tripped and fell while walking over a raised portion of asphalt relating to a crack repair where a pedestrian bridge over San Tomas Aquino Creek in Santa Clara, California, just north of Tasman Drive, between the Santa Clara Convention Center and Levi Stadium, meets a trail. A true and correct copy of the Claim (with privacy redactions), including all attached materials, is Attachment 1 hereto.
Based on Valley Water’s books and records, Valley Water conveyed the real property where this incident occurred to the Redevelopment Agency for the City of Santa Clara in May, 1985, which then constructed the pedestrian bridge at issue and a ramp west of the creek. A true and correct copy of Valley Water’s records showing the conveyance of this property is attached hereto as Attachment 2. Upon information and belief, the Redevelopment Agency for the City of Santa Clara was subsequently dissolved, and the City of Santa Clara is its successor agency. Counsel for Valley Water informed Claimant’s counsel (Peter Fisher, Esq. of Curtis Legal Group) of these facts and also provided this Attachment 2 to counsel.
Valley Water does not own or maintain the pedestrian bridge or underlying real property where this incident allegedly occurred. For this reason, Valley Water staff recommends that this Claim be denied.
