SUMMARY:
Santa Clara Valley Water District (Valley Water) received a claim August 16, 2024, from property owner Fariba Seyed regarding a sinkhole that was exposed under the concrete driveway of her home located at 25525 Adobe Lane in Los Altos Hills. The sinkhole was discovered by Ms. Seyed in the end of January 2024 and was reported to Valley Water in February.
The claimant is seeking unspecified monetary damages.
Valley Water conducted physical inspections of the sinkhole opening, a closed-circuit television (CCTV) inspection of the Diversion's interior, and geophysical survey of soil stiffness and density between 25525 Adobe Lane and the Diversion in attempt to determine whether the Diversion caused or contributed toward the formation of the observed sinkhole.
Based on Valley Water's completed investigation, there is no indication that Valley Water's 8-foot diameter concrete pipe under Adobe Lane, referred to by Valley Water as the Adobe Creek Diversion (Diversion), caused the sinkhole on Ms. Seyed's property.
At Ms. Seyed's request, Valley Water has provided her with documents relating to the Adobe Creek bypass pipe and the Adobe Creek structure, in addition to documents relating to Adobe Lane in Los Altos.
Staff has determined that there is no negligence on the part of the Valley Water. Therefore, there is no liability on the part of Valley Water and staff recommends that the claim be denied.
