Approve the Relocation Plan for the Upper Llagas Creek Flood Protection Project.

SUMMARY:
The Santa Clara Valley Water District (District) is undertaking the Upper Llagas Creek Flood Protection Project (Project) in partnership with the U. S. Army Corps of Engineers and the City of Morgan Hill (City) to improve flood protection to approximately 1,100 homes and 500 businesses in the City and various unincorporated areas of Santa Clara County, including San Martin.

The Project includes modifications to approximately 6.3 miles of Upper Llagas Creek and approximately 4 miles of West Little Llagas Creek. The planned creek channel improvements require acquisition of additional rights-of-way for the Project. Forty-one (41) parcels must be acquired for Phase 1 construction (Reach 4, Reach 7a diversion, and the on-site compensatory mitigation - Lake Silveira). An additional 100 parcels must be acquired for Phase 2 construction (a portion of Reach 5 and Reaches 6, 7B, 8, and 14). All Project Reaches are shown in Attachment 2.

Two properties, one a residential and the other a business, will require permanent relocation of the owner and tenant, respectively. As required by law, Overland, Pacific and Cutler, Inc., was contracted to prepare a Relocation Plan for the Project. (Attachment 1).

Relocation Plan

Board approval of the Relocation Plan for Upper Llagas Creek Flood Protection Project is required. In accordance with California law (title 25, Section 6038 (e)(1), a Relocation Plan must be prepared and submitted to the Board (or local legislative body) when residential and/or commercial properties are impacted by a project.
