Recommendation

Approve nominating Director Tony Estremera as the Special District Representative on the Countywide Redevelopment Agency Oversight Board.

SUMMARY:

As part of the dissolution of redevelopment agencies (RDAs), oversight boards were established for each of the redevelopment successor agencies charged with winding down the affairs of the former RDAs. In September 2015, Governor Brown signed SB107, a bill which required the consolidation of RDA oversight boards for each former RDA, which have been operational since early 2016. SB107 mandated the consolidation of these boards by July 1, 2018, with a single new countywide board in each county. In Santa Clara County, the existing oversight boards will be consolidated into a Countywide Oversight Board. The law further directs that the Local Agency Formation Commission of Santa Clara County convene the Independent Special District Selection Committee (ISDSC) in each county to appoint special district representatives to the new board. Alternates will also be appointed. Should the ISDSC fail to appoint special district representatives by July 15, 2018, the Governor is empowered to make the appointments.

 

ISDSC Membership and Meeting

The ISDSC membership is comprised of presiding officers of the following 17 independent special districts in Santa Clara County:

1. Aldercroft Heights County Water District

2. Burbank Sanitary District

3. Cupertino Sanitary District

4. El Camino Healthcare District

5. Guadalupe Coyote Resource Conservation District

6. Lake Canyon Community Services District

7. Lion’s Gate Community Services District

8. Loma Prieta Resource Conservation District

9. Midpeninsula Regional Open Space District

10. Purissima Hills Water District

11. Rancho Rinconada Recreation and Park District

12. San Martin County Water District

13. Santa Clara Valley Open Space Authority

14. Santa Clara Valley Water District

15. Saratoga Cemetery District

16. Saratoga Fire Protection District

17. South Santa Clara Valley Memorial District

 

The presiding officer of the SCVWD is the present-day Board Chair, currently Director Santos. 

 

At the May 10, 2018 meeting, the ISDSC will select a primary representative and an alternate representative, in the event the primary representative is unable to attend a meeting of the Countywide RDA Oversight Board.

 

Process for Selection of Special District Representatives to Serve on the Countywide RDA Oversight Board

Any member of an independent special district governing board may submit nominations for the two positions. The nominees need not be special district board members. Each nominee will be given an opportunity to make a brief statement. A ballot will be provided to the members of the ISDSC (i.e., to each presiding officer or voting delegate of independent special districts) present at the meeting. Each member of the ISDSC is entitled to one vote.

 

If only one nomination is received for a position, that nominee is selected. If more than one nomination is received, the nominee who receives the majority of the votes cast is selected. If no nominee receives a majority of the votes cast, a run-off election between the two nominees who receive the greatest number of votes is held. After votes are tallied, the results will be announced.

 

Each of the appointees shall serve at the pleasure of the ISDSC, there is no statutory provision for a length of term.

 

SCVWD Nomination

Board Chair Santos is requesting that the Board approve placing in nomination Director Tony Estremera as the Special District Representative on the Countywide RDA Oversight Board. Director Estremera is currently the District’s representative on the San Jose Redevelopment Success Agency.  

 

At the March 5, 2018 meeting, the Santa Clara County Special Districts Association, acted recommend to the Selection Committee that Director Estremera be appointed as the primary member, and that a member of the Midpeninsula Regional Open Space District be appointed as the alternate as the special district’s representative.  Attached is a letter from the Santa Clara County Special Districts Association conveying this action (Attachment 1).

 

 

 

FINANCIAL IMPACT:

There is no financial impact associated with this item.

 

 

CEQA:

The recommended action is a ministerial action and thus is not subject to the requirements of CEQA.
