SUMMARY:
The District received a claim on June 19, 2018 from San Jose resident, George Clark. According to the claimant, the water softener in his home was damaged due to the exposure of chloramine in the water. The claimant is seeking reimbursement for $1,595.00 for the replaced water softener.
Staff has reviewed this matter and found that there is no negligence on the part of the District. Therefore, there is no liability on the part of the District.
The District is not responsible for the damages to the water softener and recommends that the claim be denied.
FINANCIAL IMPACT:
There is no financial impact associated with this item.
CEQA:
The recommended action does not constitute a project under CEQA because it does not have a potential for resulting in direct or reasonably foreseeable indirect physical change in the environment.
