Recommendation

Approve and authorize the CEO to execute Amendment No. 2 to Standard Consultant Agreement No. A4056G with Stantec Consulting Services, Inc., for consulting services to assist in negotiations with the California Water Commission for the Pacheco Reservoir Proposition 1 Application Project for a not-to-exceed fee of $80,000, resulting in a total not-to-exceed fee of $1,272,751 and to extend the Agreement term.

SUMMARY:

On February 28, 2017, the Board authorized the Chief Executive Officer (CEO) to execute a single source agreement with Stantec Consulting Services, Inc. (Consultant), to prepare a Proposition 1 funding application (Application) for the Pacheco Reservoir expansion.  The scope of services included identifying and evaluating expansion alternatives; quantifying the benefits for the expansion using guidelines established by the California Water Commission Water Storage Investment Program Final Rule Making Package dated January 23, 2017; compiling, reviewing, and updating cost estimates for the expansion; preparing high level environmental documentation; and assisting in preparation of the application and supporting materials.  The District submitted the Application to the California Water Commission (CWC) on August 14, 2017. 

 

On December 19, 2017, the Board authorized the CEO to execute Amendment No. 1 to the Agreement, allowing for additional consultant support services post application submission.  The amendment was necessary due to the extent of work required to comply with the CWC demand for additional information following the application submittal. The amendment did not extend the duration of the Agreement, and as a result, the Agreement will expire on August 30, 2018.

 

On July 24, 2018, the CWC approved the District’s full funding request of $484.55 million.  The CWC also approved Early Funding of $24.2 million.

 

Amendment No. 2 will extend the term of the Agreement through January 31, 2019 and add an additional $80,000 in contract funds.  The primary purpose of the additional funds is to provide technical support services as outlined in Task 6 of the Agreement to support the District during negotiation of agreements with the CWC and, as necessary, other State agencies, for Early Funding and subsequent release of the full funding amount.  Secondarily, the additional funds will be utilized to explore the ability of the District to apply for federal funds for the unfunded portion of the construction costs of the Pacheco Reservoir Expansion Project.  As the level of need for additional assistance from the Consultant is uncertain, additional District written direction will be required prior to the Consultant proceeding on each identified subtask. 

 

 

FINANCIAL IMPACT:

The not-to-exceed fee for Amendment No. 2 to Agreement A4056G is $80,000, resulting in a total not-to-exceed fee of $1,272,751.00.   There are sufficient funds available in the Board adopted Fiscal Year 2019 budget for the Imported Water Program, Project Number 91131004, to encumber the amendment amount. These costs will be recovered through groundwater charges.

 

 

CEQA:

The recommended action does not constitute a project under CEQA because it does not have the potential for resulting in direct or reasonably foreseeable indirect physical change in the environment.
