Approve and authorize the CEO to execute Amendment No. 2 to Agreement No. A4055F, with Kadesh and Associates for Federal Lobbying Services, for a total funding amount during the approximate three-year period (March 9, 2017, through February 28, 2020) for a not-to-exceed fee of $338,400.

SUMMARY:

Staff desires to exercise its second and final one-year option to renew and extend the duration of the Agreement by 12 months, ending on February 28, 2020. There has been one Amendment to this contract to date. Amendment No. 1 was the first one-year option to renew and was approved by the Board on May 22, 2018.

 

The Agreement was originally signed on March 9, 2017, for a one-year period ending February 28, 2018, with an option for the District to extend the Agreement for two additional one-year periods. The Agreement expired February 28, 2018, and invoices for services provided for the months of March and April 2018 were not paid. Amendment No. 1, which the Board approved on May 22, 2018, retroactively extended the Agreement from its expiration date of February 28, 2018, to February 28, 2019, and retroactively allowed for the March and April invoice payments. The payment of services for this two-year period (03/09/17-02/28/19) was $225,600 (with $112,800 paid per year). Execution of Amendment No. 2 to renew the Agreement for the final year will result in an increase of the Agreement not-to-exceed amount from $225,600 to $338,400. The monthly fixed fee amount for services provided by the Consultant will remain at $9,400/month during the extended 12-month extension (02/28/19-02/28/20).

 

Approval of the recommended action will allow the Consultant to continue to provide critical legislative advocacy and lobbying services with a focus on elected officials and congressional committees on the District’s behalf in Washington, D.C. These services will enable the District and its Board of Directors to achieve a high level of influence in national public policy issues and increase the probability for securing federal funding for local flood protection and water supply projects. Staff is requesting that the Board approve this Amendment No. 2, thereby extending the term of the Agreement from its current expiration of date of February 28, 2019, to February 28, 2020.

 

Additionally, on the Revised Schedule A-Gen-Scope of Services, Section 1A, Representatives, of the Agreement, the following administrative change would be included as part of Amendment No. 2 to the Agreement:

 

1.                     Change Project Manager name from “Mita Prakash” to “Beckie Zisser.”

 

 

FINANCIAL IMPACT:

Approval of Amendment No. 2 shall not exceed the amount of $338,400 for the three-year period of March 9, 2017, through February 28, 2020. There are adequate funds in the Office of Government Relation’s Board-adopted FY 2018-2019 budget, Project 60231003 Federal Government Relations, to encumber the necessary fees to support the Consultant's services through the remainder of the current fiscal year. Fees for work to be performed in future fiscal years will be budgeted accordingly.

 

 

CEQA:

The recommended action does not constitute a project under CEQA because it does not have a potential for resulting in direct or reasonably foreseeable indirect physical change in the environment.
