Approve Amendment No. 3 to Agreement No. A4055F with Kadesh and Associates, LLC., for Federal Lobbying Services, to increase the not-to-exceed fee from $338,400 by $37,600, resulting in a total not-to-exceed fee of $376,000, and extend the Agreement term to June 30, 2020.

SUMMARY:
Staff desires to extend the duration of the Agreement to June 30, 2020, and increase the total not-to-exceed fee to $376,000. Extending the term to June 30, 2020 would allow the new Agreement to run on a fiscal year basis, consistent with other contracts.
The Agreement was originally signed on March 9, 2017, for a one-year period ending February 28, 2018, with an option for Valley Water to extend the Agreement for two additional one-year periods. Amendment No. 1, which the Board approved on May 22, 2018, retroactively extended the Agreement from its expiration date of February 28, 2018, to February 28, 2019. The payment of services for this two-year period (03/09/17-02/28/19) was $225,600 ($112,800 per year). Amendment No. 2, which the Board approved on January 22, 2019 renewed the Agreement for the final year and increased the Agreement’s not-to-exceed amount from $225,600 to $338,400.
Approval of the recommended action will allow this agreement to run on a fiscal year basis, consistent with other contracts. It also will allow the Consultant to continue to provide critical legislative advocacy and lobbying services with a focus on elected officials and congressional committees on Valley Water’s behalf in Washington, D.C. These services will enable Valley Water and its Board of Directors to achieve a high level of influence on federal policy and increases the probability for securing federal funding for local flood protection and water supply projects. Staff is requesting that the Board approve Amendment No. 3, thereby extending the term of the Agreement to June 30, 2020. Beginning on July 1, 2020, a new Agreement would take effect.

Amendment No. 3 to this Agreement will increase the not-to-exceed fee from $338,400 by $37,600 to $$376,000 and extend the current expiration from February 28, 2020, to June 30, 2020. The monthly fixed fee amount for services provided by the Consultant will remain at $9,400/month during the extended 4-month extension term for February 28, 2020 through June 30, 2020.
FINANCIAL IMPACT:
Approval of Amendment No. 3 shall not exceed the amount of $37,600 for the period of February 28, 2020, through June 30, 2020. There are adequate funds in the Office of Government Relation’s Board-adopted FY 2019-2020 budget, Project 60231003 Federal Government Relations, to encumber the necessary fees to support the Consultant’s services through the remainder of the current fiscal year.
CEQA:
The recommended action does not constitute a project under CEQA because it does not have the potential for resulting in direct or reasonably foreseeable indirect physical change in the environment.
