RECOMMENDATION: Recommendation
Approve Amendment No. 2 to Agreement No. A4265G with Carpi and Clay, Inc., for Federal Representation Services, to increase the not-to-exceed fee from $230,400 by $120,000, resulting in a total not-to-exceed fee of $350,400, and extend the Agreement term to June 30, 2022.

SUMMARY:
Staff desires to exercise its second one-year option to renew and extend the duration of the Agreement by 12 months, ending on June 30, 2022. Execution of Amendment No. 2 to renew this Agreement will result in an increase of the Agreement not-to-exceed amount from $230,400 by $120,000, resulting in a total not-to-exceed fee of $350,400. Staff recommends increasing the monthly fixed fee amount for services provided by the Consultant by $200/month, for a total of $10,000/month during the extended 12-month period.
The Agreement was originally signed on June 7, 2019, for a one-year period ending June 30, 2020, with an option for Santa Clara Valley Water District (Valley Water) to extend the Agreement for two additional one-year periods.
Amendment No. 1 to this Agreement was executed on June 9, 2020, which increased the not-to-exceed fee from $112,800 by $117,600 to $230,400 and extended the term expiration from June 30, 2020, to June 30, 2021. The monthly fixed fee amount for services provided by the Consultant was increased by $400 from $9,400/month to $9,800/month through June 30, 2021.
Approval of the recommended action will allow the Consultant to continue to provide critical legislative advocacy and lobbying services with a focus on appointed officials and executive agency staff on Valley Water’s behalf in Washington, D.C. These services will enable Valley Water and its Board of Directors to achieve a high level of influence in national public policy issues and increase the probability for securing federal funding for local flood protection and water supply projects.

Amendment No. 2 to this Agreement will increase the not-to-exceed fee from $230,400 by $120,000 to $350,400 and extend the current expiration from June 30, 2021, to June 30, 2022. The monthly fixed fee amount for services provided by the Consultant will increase by $200/month to $10,000/month through June 30, 2022.
FINANCIAL IMPACT:
Approval of Amendment No. 2 shall not exceed $350,400 through June 30, 2022. The monthly fixed fee for services provided is $10,000 for a total not-to-exceed amount of $120,000/year. There are adequate funds in the Office of Government Relation’s Board-adopted FY 2021-2022 budget, Project 60231003 Federal Government Relations, to cover the expenditure.
CEQA:
The recommended action does not constitute a project under CEQA because it does not have a potential for resulting in direct or reasonably foreseeable indirect physical change in the environment.
