RECOMMENDATION:Recommendation

A.                     Consider the Eighth Addendum to the Environmental Assessment/Initial Study-Mitigated Negative Declaration for the Silicon Valley Advanced Water Purification Center;

B.                     Approve the Silicon Valley Advanced Water Purification Center Storage Building Project;

C.                     Adopt Plans and Specifications and Authorize Advertisement for Bids for construction of the Silicon Valley Advanced Water Purification Center Storage Building Project per the Notice to Bidders; and

D.                     Authorize the Designated Engineer to issue addenda, as necessary, during the bidding process.

 

 

Body

SUMMARY:

The objective of the Silicon Valley Advanced Water Purification Center (SVAWPC) Storage Building Project (Project) is to construct a suitable storage facility for parts and materials used in the maintenance and operation of the SVAWPC. Completion of the Project will support Santa Clara Valley Water District’s (Valley Water) ongoing operations to efficiently produce purified water to enhance the quality of the recycled water in support of the South Bay Water Recycling (SBWR) partnership.

 

The scope of work includes constructing an approximately 1,500 square foot pre-engineered metal storage building and appurtenant improvements.

 

Staff is recommending the Board approve the plans and specifications and authorize advertisement for bids for construction of the Project per the Notice to Bidders (Attachment 4).

 

Project Background

 

The SVAWPC produces 8 million gallons a day of purified water and is located on City of San Jose property. The SVAWPC is operated and maintained by Valley Water pursuant to a Ground Lease and Property Use Agreement between the City of San Jose and Santa Clara Valley Water District for Advanced Water Treatment Facility (Lease Agreement) and the Recycled Water Facilities and Programs Integration Agreement Between the City of San Jose and the Santa Clara Valley Water District (Integration Agreement).

 

The Project will provide additional dry storage space for various materials, such as pipes, valves, gaskets, pumps, hoses, electrical supplies, and control systems supplies needed to support ongoing maintenance activities. The building will be equipped with a fire suppression system and electrical facilities. The additional storage capacity will help support existing and future needs.

 

Relevant Prior Board Actions

 

On February 23, 2010, the Board conducted a public hearing on the Final Environmental Assessment/Initial Study-Mitigated Negative Declaration (EA/IS-MND) and the Engineer’s Report for the construction of the South Bay Advanced Recycled Water Treatment Facility Project; adopted Resolution 10-15 adopting the EA/IS-MND and the Mitigation and Monitoring Report Program; adopted Resolution 10-16 to approve the Engineer’s Report. The South Bay Advanced Recycled Water Treatment Facility Project was subsequently renamed the Silicon Valley Advanced Water Purification Center.

 

On February 23, 2010, the Board also approved the Ground Lease and Property Use Agreement between the City of San Jose and Santa Clara Valley Water District for Advanced Water Treatment Facility (Agreement No. A3350S) and the Recycled Water Facilities and Programs Integration Agreement between the City of San Jose and the Santa Clara Valley Water District (Agreement No. A3351S).

 

Permits

 

Pursuant to the Lease Agreement, Valley Water is required to obtain approval from the City of San Jose’s (City) Director of Environmental Services and be responsible for the payment of all engineering, inspection and review fees required by the City and any other government entity.

 

Valley Water has received plan check approval from the City’s Public Works Department and paid for all engineering and review fees incurred to date. The City’s Director of Environmental Services has also approved the Project (Attachment 1). A building permit will be required (to be obtained by the Contractor) prior to construction.

The Project is covered under the Santa Clara Valley Habitat Plan, and the application of conditions and avoidance and minimization measures required have been incorporated into the Project’s design and construction documents. No additional real property interests must be acquired to construct the Project as it will be located on City of San Jose property.

 

Next Steps

 

If the Board approves the recommendations, staff will proceed to advertise the Project for construction bids. Board award of a construction contract is planned for March 2022.

 

 

 

ENVIRONMENTAL JUSTICE IMPACT:

There are no Environmental Justice impacts associated with this item.

 

 

FINANCIAL IMPACT:

The estimated construction contract cost for the Project is between $500,000 and $600,000. This small capital project is included in the Small Capital Improvements, Water Treatment Project No. 93764004 in the Five-Year 2022-26 Capital Improvement Program (CIP). There are adequate funds in the Board-adopted FY 2021-22 budget to encumber the total cost for the proposed construction contract. The Project is funded by the Water Utility Enterprise Fund, with 100% of the cost allocated to Zone W-2 (North County).

 

 

CEQA:

The Final Environmental Assessment/Initial Study-Mitigated Negative Declaration (EA/IS-MND) (Attachment 2) for the South Bay Advanced Recycled Water Treatment Facility (ARWTF) Project was prepared in accordance with the California Environmental Quality Act (CEQA). On February 23, 2010, the Board adopted the Final Environmental Assessment/Initial Study-Mitigated Negative Declaration and Mitigated Monitoring and Reporting Program before approving the South Bay Advanced Recycled Water Treatment Facility Project.  The South Bay Advanced Recycled Water Treatment Facility Project has subsequently been renamed the Silicon Valley Advanced Water Purification Center.

 

Pursuant to CEQA Guidelines Section 15164, an addendum to an adopted negative declaration may be prepared if some changes or additions are necessary but none of the conditions described in CEQA Guidelines Section 15162 (i.e., no new significant environmental effects or a substantial increase in the severity of previously identified significant effects) requiring preparation of a subsequent EIR or negative declaration have occurred. The Eighth Addendum to the EA/IS-MND (Attachment 3) has been prepared by staff to evaluate the environmental effects of proposed modifications to the approved Silicon Valley Advanced Water Purification Center Project to add a new storage building.

The Eighth Addendum concludes that the proposed Project modifications would not result in any new significant impacts or substantial increase in severity of previously identified significant impacts.   Therefore, it is appropriate to prepare an Addendum to document Valley Water’s additional CEQA review.  Pursuant to CEQA Guidelines Section 15164(d), the Board must consider the Eighth Addendum along with the EA/IS-MND before approving the Project.
