RECOMMENDATION:

Recommendation

A.                     Open and conduct a public hearing on the Engineer's Report and the CEQA Exemption Determination for the Coyote Pumping Plant Adjustable Speed Drive Replacement Project (Project);

B.                     Close the Public Hearing;

C.                     Approve the CEQA Exemption Determination for the Project;

D.                     Adopt a Resolution APPROVING THE ENGINEER'S REPORT FOR THE COYOTE PUMPING PLANT ADJUSTABLE SPEED DRIVE REPLACEMENT PROJECT; and

E.                     Approve the Project.

 

 

Body

SUMMARY:

On November 8, 2022, the Board adopted a resolution setting the time and place for the public hearing on the Engineer’s Report to take place on November 22, 2022. Staff is recommending the Board hold this public hearing and consider adoption of the Resolution (Attachment 4) to approve the Engineer’s Report, approve the CEQA exemption determination, and approve the Project.

 

Project Background

The Coyote Pumping Plant was constructed in 1986 and its equipment is mostly unchanged since the original construction, except replacement of components due to failure or wear. With 33 years in service, the electrical, mechanical, and heating, ventilation, and air conditioning (HVAC) systems have reached the end of their expected useful life. Staff has found it increasingly difficult to obtain parts and services for some key equipment, as the original equipment manufacturers no longer support these systems.

 

The Project objective is to replace six adjustable speed drives and associated mechanical, electrical, and control equipment at the Coyote Pumping Plant. Completion of this Project will modernize and extend the useful life of major equipment and allow for its reliable and efficient operation. The estimated total cost to plan, design, and construct this Project is $27.3 million.

 

Engineer’s Report

Section 12 of the District Act requires the Board to conduct a public hearing to consider all written and oral objections to a proposed project when: 1) the project is new construction; and 2) the project is funded by a single or joint zone of benefit. Staff prepared an Engineer’s Report (Attachment 2) for the purpose of public disclosure. The Public Hearing Notice (Attachment 3) for the Engineer’s Report was published in accordance with the District Act and posted outside Valley Water’s Offices at 5700 Almaden Expressway, San Jose, California, 95118, and on Valley Water’s website at <https://www.valleywater.org/public-review-documents>.

 

Next Steps

If the Board approves the proposed Project, the future milestones are:

 

1.                     Board approval of the Design-Build Agreement for Phase 1 (Design and Pre-Construction services)

2.                     Completion of Phase 1 scope of services identified in the Design-Build Agreement to perform 60%, 90%, final design, and preconstruction services

3.                     Board approval of amendment to Design-Build Agreement authorizing issuance of early work packages

 

 

ENVIRONMENTAL JUSTICE IMPACT:

Although there are no Environmental Justice Impacts, the public hearing allows community members to provide input into the decision-making process.

 

 

FINANCIAL IMPACT:

The proposed Project is included in the Five-Year 2023-27 Capital Improvement Program (CIP). The estimated cost to plan, design, and construct the Project is $27.3 million. Funds are included in the FY2022-23 Board-adopted budget for the planned Project spending during the current fiscal year. Funds to cover each subsequent fiscal year anticipated Project costs would be recommended by staff during each fiscal year budget process or through budget adjustment(s). The proposed Project would be funded by the Water Utility Enterprise Fund (Fund 61) with 100% of the costs allocated to Zone W-2 (North County).

 

 

CEQA:

Staff has reviewed the proposed Project for CEQA compliance and concluded that it qualifies for a Categorical Exemption under CEQA Guidelines Section 15301; Existing Facilities [Class 1 - operation, repair, maintenance, minor alteration of existing structures and facilities]. A Notice of Exemption has been prepared (Attachment 1) and is ready to be filed with the County of Santa Clara, Office of the Clerk/Recorder upon Board approval of the Project.
