RECOMMENDATION:

Recommendation

A.                      Accept the County of Santa Clara Registrar of Voters’ Certificates of Election Results and Statement of Votes for District 6 and District 7, declaring the totals to be the final results of the election, and declaring elected the person having received the highest number of votes for this office; and

B.                     Accept the Santa Clara County Registrar of Voters’ Certificate of Election Facts and Request to Fill Elective Office by Appointment for District 1 and District 4.

SUMMARY:

Elections for the seven electoral districts established pursuant to the District Act are conducted in accordance with the California Elections Code, commencing with §10500 et seq.  Elections for Districts 1, 4, 6 and 7 were held on November 8, 2022, for terms beginning on December 2, 2022, through December 2026.

Elections Code §15400 requires that the governing body (Board of Directors) accept the Statement of Votes and Certificates of Election Results and declare the totals to be the final results of the election.

 

On November 8, 2022, a general election was held in the County of Santa Clara, for the Santa Clara Valley Water District for the purpose of electing Directors for District 6 and 7.  Current Director Tony Estremera was elected to the office of Director for District 6, and Rebecca Eisenberg was elected to the office of Director for District 7, with terms ending in 2026.  The Registrar’s Certificate of Election results for District 6 and District 7 certifying this election and the Statement of Votes for District 6 and District 7 elections are included as Attachment 1.

 

For the November 8, 2022, general election, Districts 1 and 4 each only had one candidate file a Declaration of Candidacy, current District 1 Director, John L. Varela and Jim Beall for District 4.  The Registrar of Voters (Registrar) did not receive any petitions requesting that elections be held for these districts.  So, in accordance with California Elections Code §10515, the Registrar submitted a Certificate of Election Facts and Request to Fill Elective Office by Appointments for District 1 and 4 to the County Board of Supervisors, as the supervising authority over the elections, requesting that John L. Varela and Jim Beall be appointed to the offices of Director for District 1 and 4, respectively.  On September 13, 2022, the Board of Supervisors accepted the Registrar’s certificate of election results appointing John L. Varela and Jim Beall.  No elections were required for these districts.  A copy of the Registrar’s Certificate of Election Facts and Request to Fill Elective Office by Appointment is included as Attachment 2.
